Terms of Service

AudSpec is a sales prospecting tool. It researches your market, finds business contacts, drafts outreach with AI, sends it from the mailbox you connect, reads prospect replies and drafts answers. Features may change over time as we improve the product.

• You must be at least 18 and able to enter a contract for yourself or your business.
• Keep your sign-in details secure. You're responsible for activity on your account.
• If you use AudSpec for a company, you confirm you're authorised to accept these terms for it.

• A payment card is required to use AudSpec. Adding it doesn't charge you. New accounts receive 175 free credits once.
• Actions such as revealing a lead, sending an email and drafting AI replies use credits, at the rates shown on the Pricing page. Plans also set daily and account limits.
• Paid plans are billed monthly in advance and renew automatically until cancelled. You can cancel any time. Cancellation takes effect at the end of the current billing period.
• Plan credits carry over for 30 days after the month they were granted for, then expire. Top-up credits expire 365 days after purchase. Credits have no cash value and can't be transferred.
• Each plan includes a maximum number of leads your account can hold. Extra lead space is a monthly add-on to a paid plan. Adding it is charged pro rata straight away; removing it takes effect immediately, without a refund for the current month.
• Upgrades take effect right away and are charged the prorated difference. Downgrades take effect at the next renewal.
• Payments are non-refundable except where the law requires otherwise, or where we decide to issue a refund or credit.
• We may change prices or credit rates with at least 30 days' notice. Changes apply from your next billing period.

Emails are sent from your own mailbox, in your name. You're responsible for who you contact and what you send, and for following the laws that apply to you and your recipients, including anti-spam and privacy laws such as CAN-SPAM, the GDPR, the UK PECR and Canada's CASL. You agree not to:

• send deceptive, misleading, harassing, unlawful or harmful messages;
• contact people who have opted out, or remove or hide the opt-out AudSpec adds;
• send bulk unsolicited email beyond your plan's limits or your mail provider's rules;
• upload or send sensitive data (such as health, financial or government ID information) about prospects;
• resell or share contact data obtained through AudSpec, or use it outside AudSpec for purposes unrelated to your outreach;
• interfere with, probe or reverse engineer the service, or get around its limits.

We may suspend sending or accounts that put recipients, mail providers or the service at risk.

By connecting a mailbox, you authorise AudSpec to send the emails you approve (or set to send automatically) and to read incoming email to find replies from your prospects. You can disconnect at any time in Settings. How we handle mailbox data is described in our Privacy Policy.

AudSpec uses AI to research, draft and classify. AI output can be wrong or incomplete. You are responsible for reviewing drafts before approving them, and for anything sent in auto-reply mode. Information about companies and contacts comes from public sources and third-party data providers, and may be out of date.

You own the content you add to AudSpec, such as your knowledge, persona settings, campaigns and emails. You give us permission to host and process it only to provide and improve the service for you. You confirm you have the rights to the content you add.

AudSpec works with services such as Google, your email provider, Stripe and data providers. Your use of those services is also subject to their own terms, and we aren't responsible for them.

You can stop using AudSpec and cancel at any time. We may suspend or end your access if you break these terms, don't pay, or use the service in a way that could cause harm. Unused credits end when an account is closed for a breach of these terms.

AudSpec is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee any particular results, such as deliverability, reply rates or meetings booked.

To the extent the law allows, AudSpec won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the amount you paid AudSpec in the 12 months before the claim.

You'll defend and indemnify AudSpec against claims arising from the emails you send, the content you add, or your breach of these terms or the law.

These terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. Any dispute relating to these terms or the service will be heard in the state or federal courts located in Arizona, and you and AudSpec consent to their jurisdiction. Nothing here limits rights you have under the consumer protection laws of the place where you live.

We may update these terms. We'll post the new version here with a new effective date and, for significant changes, tell you by email or in the app. Continuing to use AudSpec after a change means you accept it.
